Please read these Terms of Service carefully before using Viziqo Assist. These Terms constitute a legally binding agreement between you and Viziqo governing your access to and use of the Service.

1. Acceptance of Terms

By accessing or using Viziqo Assist ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all users, including administrators, team members, and end-customers interacting through widgets powered by the Service.

2. Description of Service

Viziqo Assist is an AI-powered customer support platform that provides voice, web chat, WhatsApp, SMS, and multi-channel automation capabilities. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

3. Account Registration

You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.

4. Acceptable Use

You agree not to use the Service to: (a) violate any applicable law or regulation; (b) send spam, unsolicited messages, or engage in phishing; (c) upload or transmit malicious code; (d) impersonate any person or entity; (e) interfere with or disrupt the integrity or performance of the Service; (f) attempt to gain unauthorised access to the Service or its related systems.

5. Subscription and Billing

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as otherwise specified in our refund policy. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension or termination of your account.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy. You retain ownership of all data you upload to the Service.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Viziqo and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes.

8. AI-Generated Content

The Service uses AI models to generate responses. AI-generated content may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing AI outputs before relying on them for critical decisions. We do not guarantee the accuracy, reliability, or fitness of AI-generated responses for any particular purpose.

9. Limitation of Liability

To the maximum extent permitted by law, Viziqo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service. Our total liability for any claim shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Viziqo and its officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your account and access to the Service at our sole discretion, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. You may cancel your account at any time from the billing settings within the dashboard.

12. Changes to Terms

We reserve the right to update these Terms at any time. We will provide at least 14 days' notice of material changes by email or in-app notification. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts, and you consent to personal jurisdiction in such courts.
